These are the rules for using Eugene Night Out: what we do, what you agree to, how offers and claims work, and what happens when something goes wrong.

Agreeing to these terms
By creating an account or using Eugene Night Out, you agree to these terms and to our Privacy Policy. Eugene Night Out is a brand operated by Eugene Night Out LLC (“we”, “us”). If you do not agree, please do not use the service.

Who can use it
You must be at least 18 to create an account.
Offers involving alcohol are only for people 21 and over. The business checks ID and may refuse an offer if you cannot show it.
One account per person. Accounts are for personal use, not for claiming on behalf of others.

Optional text message program
Texts are optional. Agreeing to these terms does not sign you up for texts. You only get texts if you tick a text box at sign-up, on the Text alerts page or in Preferences. Consent to texts is not a condition of creating an account, claiming an offer or any purchase.
Program name: Eugene Night Out Text Alerts. Marketing texts about new offers and events, and texts about offers you claim, are separate programs you agree to separately. Marketing comes in two versions: 21+, which may include offers involving alcohol, and ages 18 to 20, which never does. You enter your full date of birth before you can join, and it decides which version you get.
What it sends: if you agreed to marketing texts, texts about new offers and events, up to 3 a week; and, if you agreed separately to claim texts, a confirmation when you claim an offer and a reminder before it expires. A sign-in code is sent only when you ask for one, and is not part of either program.
Message frequency varies. Message and data rates may apply.
Text HELP for help. Text STOP to cancel at any time. You will receive one message confirming you are unsubscribed, and nothing after that.

Your account
You sign in with a link or code sent to your email, or to your phone if you choose to sign in by text. Keep that phone and inbox secure, because anyone who can open them can sign in as you. Tell us at info@eugenenightout.com if you think someone else has used your account.

How offers work
Businesses create offers, set their terms, and decide how many people can claim them. We show them to you.
Claiming an offer holds a spot until the offer expires. It is not a purchase and has no cash value.
Claims are personal. You cannot sell, transfer or share one, and a screenshot of a claim is not valid.
Every offer shows its expiry, its limit and anything it excludes. Those are the business’s terms, and they are the terms that apply.
A business can end an offer early, or refuse it for a reason stated in its terms, such as the offer window closing or ID not being shown.

Redeeming an offer
To use a claim, show the live claim screen to staff. Staff mark it redeemed, and that cannot be undone. If a business refuses an offer you believe was valid, report it within 24 hours from the redeemed screen or your wallet. We will look into it, and where we agree with you we may reinstate the claim or offer credit. We cannot guarantee that a business will honor an offer.

Fair use
Please do not:
Create more than one account, or use automated tools to claim offers.
Repeatedly claim offers you do not use. Each claim holds a spot someone else could have had, and a pattern of no-shows can lead to your account being paused.
Abuse, threaten or harass business staff or other customers.
Interfere with the service, or try to reach information that is not yours.

Businesses
Businesses that post on Eugene Night Out agree to separate business terms. Each business is responsible for its own offers and events, including making sure they comply with Oregon liquor law and OLCC rules. Our automated offer check helps businesses spot problems, but it is not legal advice, and publishing an offer does not mean we have confirmed that it is legal.

Content on the service
Offers, events, photos and descriptions come from businesses. We try to keep listings accurate, but if a listing differs from what the business offers at the door, the business’s terms apply. We may remove content that breaks these terms or the law.

Your calendar link
Your calendar subscription link is private to you. Anyone with the link can see your saved events. You are responsible for who you share it with, and you can reset it at any time.

Pausing or closing accounts
You can close your account at any time. We may pause or close an account that breaks these terms, puts others at risk, or is used for fraud. Where reasonable, we will tell you why and give you a chance to respond. Unused claims are released back to the business when an account closes.

Disclaimers
Eugene Night Out is provided as is. We do not run the businesses and are not responsible for what happens at them, including the food, drink, service or safety. Please drink responsibly and get home safely.

Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for any claim is limited to [LIABILITY CAP]. Nothing in these terms limits liability that the law does not allow us to limit.

Disputes
These terms are governed by the laws of the State of Oregon, and disputes will be resolved in the courts of Lane County, Oregon. [DECISION NEEDED: courts or binding individual arbitration] Before bringing a claim, please contact us at info@eugenenightout.com so we can try to resolve it.

Changes to these terms
We may update these terms. If a change matters, we will tell you by email, or by text if you have agreed to texts, before it takes effect. Continuing to use the service after that means you accept the updated terms.
