This explains what Eugene Night Out collects, why we collect it, who sees it, and how to make us delete it. We have tried to write it the way we would want it explained to us.

Who we are

Eugene Night Out is a brand operated by Eugene Night Out LLC, based in Eugene, Oregon. When this policy says “we” or “us”, it means Eugene Night Out.

What you give us

When you sign up and use Eugene Night Out, you give us:
Your mobile number or email address, which is how you sign in. There is no password.
Your name and email, if you sign in with Apple or Google. We receive what those services share and nothing else from your account.
Your date of birth, to confirm you are 18 or older and decide whether messages about alcohol can go to you. Businesses never see it.
The neighborhoods you go out in and the things you are into, if you choose them.
Which channels you want to hear from us on, how often, and your quiet hours.
Anything you send us, including reports about a business and any photos or receipts you attach.

What we collect as you use it

The offers you claim, when you claim them, and whether and when a business redeems them.
The events you save and the businesses you follow.
How you found an offer — a text, the feed or an email.
Basic device and sign-in information, so we can keep you signed in on a device you trust and notice sign-ins that are not you.
Your approximate location, only if you allow it, to show how far a business is. We do not track where you go.

What businesses give us

Businesses give us their offers, events and photos. Business owners also give us contact details and license documents so we can verify them. None of this is information about you as a customer.

How we use your information

To show you offers and events, and to hold your spot when you claim one.
To let a business’s staff confirm that your claim is real and mark it used.
To send the texts, emails and WhatsApp messages you asked for, when you asked for them.
To remind you before a claimed offer expires, if you have reminders on.
To prevent abuse, such as claiming from several accounts or never showing up.
To answer your reports and resolve disputes with businesses.
To meet legal obligations, including records a business may need for liquor regulators.

How your feed is curated

Your feed is ranked automatically. We use the neighborhoods and interests you picked, the offers you claim and redeem, and what you save. The ranking decides what you see first and what we message you about. It never changes the price or terms of an offer.
You can stop it learning, or reset it, in Preferences.

What businesses can see about you

When you claim an offer, that business sees your first name and last initial, your claim number, when you claimed and redeemed it, and how you found it.
A business can also see which other businesses’ offers you have claimed in the last 90 days, and which businesses you follow. You can switch this off in Preferences, and the business will then see only your history with them. [DECISION PENDING: confirm this default before launch]
Businesses never receive your phone number, email address or location. If a business sends you an offer, it goes through us, on the channels and at the times you chose.

Text messages

We text you only what you ticked a box for: marketing texts about offers and events are one box, texts about offers you claim are a separate box, and neither is required. Message frequency varies. Message and data rates may apply.
Reply HELP for help. Reply STOP to stop all texts — we will confirm with one final message and send nothing more.
If you are 21 or older, our texts may mention offers involving alcohol. If you are 18 to 20, they never will.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
The rules of the text program are in our Terms of Service.

Your calendar link

Your calendar link is private: anyone who has it can see your saved events. Resetting it in Calendar settings stops the old one working.

Who else we share it with

We do not sell your personal information. We share it only:
With the business whose offer you claim, as described above.
With companies that run parts of the service for us, such as text and email delivery, hosting and payments. They may use it only to provide that service to us.
When the law requires it, or to protect someone’s safety.
If the business is sold or merged, in which case this policy continues to apply to your information.

How long we keep it

Used and expired offers stay in your wallet for 90 days. When you close your account we delete or anonymize your personal information within [RETENTION PERIOD], except where the law requires us to keep a record.

Your choices and rights

You can see, correct, download or delete your information from your account at any time, or by emailing info@eugenenightout.com. You can turn off any channel, mute any business, stop curation from learning, and switch off history from other businesses.
If you live in Oregon, the Oregon Consumer Privacy Act may give you the right to confirm what we hold about you, correct it, get a copy, have it deleted, and opt out of targeted advertising, sale and certain profiling. Residents of other states may have similar rights. We will respond within the time the law requires. [LEGAL REVIEW: confirm which laws apply at our size]

Age

You must be 18 or older to join. Offers involving alcohol are only shown and sent to people 21 and over, and businesses still check ID. We do not knowingly collect information from anyone under 18.

Keeping it safe

We encrypt your information in transit and limit who can access it. Sign-in links expire after ten minutes and work once. If a breach affects you, we will tell you as the law requires.

Changes to this policy

If we change this policy in a way that matters, we will tell you before it takes effect.
